Mr.Jagdhar Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-02-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Buxar Town P.S. Case No. 690 of 2019 registered for the offences punishable under Sections 341, 323, 324, 307, 384, 385, 379/34 of the Indian Penal Code.

Allegation against the petitioners is that the informant, Jai Prakash Singh is carrying the school and run a bus for students from their home to school and school to home. Petitioners told the driver to call his owner. In the mantime,

They having abusing warn that your owner refuses to give the Rangdari. Then Khalashi of the vehicle informed the informant. When the informant reached there then Nandu Pandey pointed out pistol towards informant and demanded pay Rs.20,000/- per month Rangdari. Nikki Pandey attacked on the stomach of the informant with the knife with intention to kill. The informant any how saved him then such knife inflicted on the wrist of the informant. When the informant was fleeing away to save himself then all these accused persons ousted danda from nearby Hotel and started assaulting indiscriminately to the informant. When the informant felt down on the ground then Nandu Pandey snatched golden chain and Lattu Pandey took out the purse in which Rs.9,000/-. They again threatened to give Rs.20,000/- per month as Rangdari.

Learned counsel for the petitioners submits that the petitioners are innocent, have committed no offencde as alleged and have been falsely implicated in this case due to dirty village politics. He further submits that there is no specific allegation against the petitioners. There is general and omnibus allegation against the petitioners. Learned Sessions Judge also stated in the

Patna High Court CR. MISC. No.2289 of 2020(2) dt.28-02-2020 3/3 impugned order that all the injuries are simple in nature. He further submits that the petitioners have got no criminal antecedent.

Learned counsel for the informant submits that matter has been compromised between the parties, which is enclosed as Annexure-2 of the bail petition.

In the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No.690 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
