JUSTICE DINESH KUMAR SINGH) 06-08-2019 The present Miscellaneous Appeal has been preferred against the judgment dated 24.09.2018, passed by learned Principal Judge, Family Court, Patna in Maintenance Case No. 80(M) of 2017, whereby the issue of interim maintenance under Section 125 Cr. P.C., has been decided. As prayed for, learned counsel for the appellant is permitted to convert the present Miscellaneous Appeal into Civil Miscellaneous Application Article 227 of the Constitution of India in view of the ratio laid down in the case of Md. Akil Ahmad Vs. The State of Bihar and Anrs., reported in 2016(4) PLJR 968, by 19th of August, 2019, failing which the present application shall stand rejected without further reference to the Bench.
