Earlier the petitioner was granted conditional anticipatory bail, vide order dated 22.5.2018 passed in Cr. Misc. No.32117 of 2018 for a period of three months with direction that the petitioner shall take back his wife to her matrimonial home and keep her with full honour and dignity and if the trial court finds that both are living amicably, the provisional anticipatory bail of the petitioner shall be confirmed otherwise the provisional bail bond shall be cancelled. Submission of the learned counsel for the petitioner is that after expiry of three months, she has appeared and filed a petition for cancellation of the bail bond of the petitioner accordingly, the bail bond of the petitioner was cancelled as such the present modification application has been filed.

No.2693 of 2019(2) dt.23-01-2019 2/2 In such view of the matter, let the petitioner surrender before the learned court below and prayer for regular bail, which shall be considered by the learned court below on the fact that he has been given conditional bail and he has not misused the privilege of the bail and considering the same he will pass appropriate order if possible on the same day.
