The petitioner seeks bail in Chhatuni P.S. Case No. 239 of 2014, registered for the offences punishable under Sections 307, 354B and other Sections of the Indian Penal Code. The petitioner and two others namely Mantosh @ Manu and Jainarain Yadav were eve teasing and when protest was made the petitioner with other accused persons entered into the house of the victim the petitioner and Jainarain Yadav caught the hands and Mantosh @ Manu brutally assaulted the victim. Ten sharp cut injuries are found on the body of the victim. The injuries are grievous in nature.

Shri Bindhya Keshri Kumar learned senior counsel submits that only allegation against the petitioner is that he caught

Patna High Court Cr.Misc. No.8402 of 2015 (3) dt.23-04-2015 2/2 hands but did not assault the victim.

Considering the facts aforesaid and the fact that on protest of eve teasing, the petitioner and others entered into the house the petitioner caught hands of the victim and on such Mantosh @ Manu repeatedly assaulted the victim, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.

The petitioner may renew his prayer for bail after remaining one year in jail.
