JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Special Case No. 59 of 2016 (arising out of Vigilance P.S. Case No. 128 of 2016), registered under Section 7/13(2) and 13(1)(d) of Prevention of Corruption Act, 1988.

The accusation is of recovery of Rs. 10,000/- from the bed of the petitioner, which was taken by her as bribe being CDPO, Nautan to informant Basant Kumar Sharma, husband of Sandhya Kumari, Anganbari Sevika.

Learned counsel for the petitioner submits that, in fact, petitioner who is CDPO, Nautan has falsely been made

Patna High Court Cr.Misc. No.162 of 2017 (2) dt.11-01-2017 2/2 accused in this case as she was not ready to conceal the mischief of wife of the informant, who is Anganbari Sevika. Further submission is that petitioner has no criminal antecedent and she is in custody since 30.11.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Vigilance, North Bihar Muzaffarpur in connection with Special Case No. 59 of 2016 arising out of Vigilance P.S. Case No. 128 of 2016. (Rajendra Kumar Mishra, J) manish/- U T
