2. The petitioner seeks regular bail in connection with Sarsi P.S. Case No. 125/2023 lodged on 20.06.2023 under Section 306/34 of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against two named accused persons including the petitioner. Allegation against the present petitioner is that he eloped with the daughter of the informant on the pretext of marriage but subsequently, he refused to marry with the informant's daughter, as a result of which, the daughter of the informant committed suicide by hanging herself on a mango tree.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.7204 of 2024(2) dt.17-02-2024 2/2 petitioner is innocent and has committed no offence. The victim has committed suicide as has been disclosed in the FIR. The petitioner is in custody since 21.06.2023 having no criminal antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. Upon specific query from the learned counsel for the petitioner that whether charge has been framed or not, he submits that as per his knowledge, the charge has not been framed.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named be released on bail, after framing of charge, if not framed, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned JM 1st Class, Purnea, in connection with Sarsi P.S. Case No. 125/2023, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure. (Dr. Anshuman, J) Ashwini/- U T
