JUSTICE SUDHIR SINGH ORAL ORDER 18-04-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 304B/34 of the Indian Penal Code. Allegation against the petitioners is that they have killed the deceased due to non-fulfilment of demand of additional dowry. It is submitted on behalf of the petitioners that They have got no criminal antecedent. Petitioner no. 1 is Bhanoi of the deceased and petitioner nos. 2 and 3 are the agnate of the husband of the deceased. They are separate in mess and property from the husband of the deceased. The police has submitted final form against the petitioners which is evident from perusal of Annexure2. The court has differed with the said final form submitted by the police and has taken cognizance.

On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on

Patna High Court Cr.Misc. No.11056 of 2016 (2) dt.18-04-2016 2/2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad (Bihar), in connection with Jamhore P.S. Case no. 96 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
