JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201 of the Indian Penal Code.

Petitioner is not named in the first information report and his name surfaced in this case in confessional statement of coaccused, Raghuvir Tanti and others. The aforesaid co-accused, Raghuvir Tanti and some other accused have already been granted privilege of bail by this court. Moreover, none has seen the actual killing of the deceased and the prosecution case hinges upon circumstantial evidence.
