Petitioner is in jail custody since 5.7.2014 in a case registered under section 302/34 of the Indian Penal Code. In course of investigation, witness Chhote Manjhi claimed himself to be eye-witness and stated that he had seen the petitioner and other accused committing the alleged crime but it is surprising enough that informant came to know about murder of his father through the above stated Chhote Manjhi but at the time of recording his fardbeyan, informant did not mention this fact that it was Chhote Manjhi who witnessed the alleged occurrence.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial
