BAJANTHRI ORAL ORDER 31-01-2022 The matter is heard via video conferencing due to circumstances prevailing on account of COVID-19 pandemic. State counsel accepts notice for respondent No. 1 to 5. Service of notice to Respondent No. 6 is dispensed since no adverse order is being passed in the present petition. In the instant petition, petitioner has prayed for following reliefs :- "That this is an application for issuance of an appropriate writ, order or direction to the concerned for cancellation of selection of Respondent No.6, namely, Veena Kumari on the post of 'Aangan Bari Sewika' in Ward No.15, Centre No. 204,Gram Panchayat Paigambarpur, Block Meenapur, District-Mzaffarpur lesser marks and position in merit lists than the petitioner and the

Patna High Court CWJC No.4107 of 2021(2) dt.31-01-2022 2/2 petitioner having 76% marks and Ist. Position in merit list was debarred from selection by saying that her matriculation certificate issued by 'Mahakshal Board of Secondary Education Jabalpur (M.P.) is not a recognized Board while other candidate obtaining the degree from the same Board is elected and working in other district and the petitioner further prays for a direction to select and appoint the petitioner on the place of respondent No.6 and the petitioner again further prays to grant any other relief/reliefs as the Hon'ble Court may think fit and proper."

Petitioner's relief is supported by representation dated 19.09.2019 (Annexure-2), 13.02.2020 (Annexure-3) and 14.02.2020 (Annexure-4) before the concerned authorities but the concerned authorities has not taken any decision on the petitioner's representation.

Therefore, the concerned authority is hereby directed to redress the grievance of the petitioner stated in the representation in passing speaking order and communicate the same to the petitioner within a period of three months from the date of receipt of this order along with any judicial pronouncement if any. With the aforesaid observation, this writ application is disposed off.
