JUSTICE SATYAVRAT VERMA ORAL ORDER 17-08-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. It has been submitted on behalf of the petitioner that the issue between the petitioner and the informant stands settled by the learned Mediator. The learned counsel next draws the attention of the Court to the report of the learned Mediator to submit that mediation has succeeded.
The learned counsel for the informant does not dispute the fact that mediation between the parties have conceded.
Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the
Patna High Court CR. MISC. No.4141 of 2022(5) dt.17-08-2022 2/2 event of his arrest or surrender before the learned Court below within a period of six weeks from today, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Tariyani Chapra P. S. Case No.65 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
However, in the event, if the petitioner does not fulfil the condition as agreed upon and as recorded in the order of the learned mediator, the informant will be at liberty to move before appropriate forum for cancellation of the bail of the petitioner, but this condition will apply only if the informant also in terms of the settlement arrived at, withdraws all the cases filed against the petitioner.
