1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Lakhisarai P.S. Case no. 709 of 2023, registered under sections 457 and 380 of the Indian Penal Code.

3. As per the prosecution case, theft took place in the shop of the informant and the accused persons took away various articles as mentioned in the FIR as also Rs. 3200/- in cash. The petitioner and one another were identified in the CCTV footage.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. Contrary to the allegations he has not been identified in the CCTV footage.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioner being in custody for more than 5 months since 16.9.2023, his not having any criminal antecedent and chargesheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Lakhisarai P.S. Case no. 709 of 2023, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai.
