2. The petitioner has preferred this application for grant of regular bail in connection with Ujiarpur P.S. Case No. 145 of 2025 registered for the offences punishable under Section 103(1) of the B.N.S.
3. As per the prosecution case, on 15.06.2025 at about 11:00 P.M., the petitioner came at the door of the informant and started abusing her and her family members by using filthy languages. When the husband of the informant objected the same, the petitioner pushed him on the ground and assaulted him with legs over his chest and brutally assaulted with bamboo clamp, causing serious injury to him, subsequently, when the informant was taking her husband to the hospital, he died on the

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It has further been submitted that the petitioner was unarmed. As per the allegation, the petitioner had thrashed the deceased on the ground and assaulted him with legs over his chest and brutally assaulted with bamboo clamp. It has also been submitted that the post-mortem report indicates abrasions on the left abdomen and thumb, however, there are no other external or internal injuries to substantiate the allegations of assault against the petitioner. Moreover, the opinion regarding death has been kept reserved awaiting the report of Forensic Science Laboratory (FSL). It has lastly been submitted that the petitioner has clean criminal antecedent and is in custody since 17.06.2025.
5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.
6. Considering the aforesaid submissions of the parties and taking into account the facts and circumstance of the case, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of
Patna High Court CR. MISC. No.2860 of 2026(3) dt.02-04-2026 3/3 learned Court concerned, Samastipur, in connection with Ujiarpur P.S. Case No. 145 of 2025.
7. The application stands allowed.
