Learned counsel for the petitioner places reliance on Annexure-8 to contend that the issue involved in the present writ application is no more res integra as decided in CWJC No. 16458 of 2015 (Rajendra Patel & anr. Vrs. The State of Bihar & others) vide oral judgment dated 03.12.2018. Considering the aforesaid, the writ application is

Patna High Court CWJC No.22762 of 2018(3) dt.17-02-2020 2/2 disposed of with a direction to the respondents to examine the claim of the petitioner in terms of the judgment dated 03.12.2018 passed in CWJC No. 16458 of 2015 (Rajendra Patel & anr. Vrs. The State of Bihar & others) and pass an appropriate orders in accordance with law within a period of three months from the date of receipt/production of a copy of this order.

It goes without saying that whatever dues is found to be admissible to the petitioner should be paid within time frame as indicated above.
