The petitioner seeks his bail in connection with Bela P.S. Case No.21 of 2014 registered under Sections 364 and other sections of the IPC.
The informant made specific allegation against the petitioner that it was he who asked him to go along with the accused persons from where the informant was kidnapped and kept in the house of Zulekha Khatoon. The petitioner also came there alone and demanded ransom of Rs.1 crore from the parent of the informant. The police came and apprehended accused persons and rescued the victim.
Learned counsel for the petitioner submits that the petitioner happens to be co-sharer of Pramod Rai the cousin brother of the informant and that is why, the petitioner has falsely been implicated in the case. The petitioner has got no criminal antecedent.
Having considered the facts that the victim disclosed the name of the petitioner for his kidnapping, who was recovered from
Patna High Court Cr.Misc. No.19927 of 2015 (3) dt.02-07-2015 2/2 the house of Zulekha Khatoon, and the petitioner was the kingpin, I am not inclined to enlarge the petitioner on bail and accordingly, the same is rejected.
The trial court is directed to expedite the trial and conclude the same within one year from the date of receipt/production of a copy of this order. If the trial is not concluded within one year, the petitioner may renew his prayer for bail.
