This application for anticipatory bail, arises out of Dulhin Bazar Police Station Case No. 292 of 2018, disclosing offences punishable under Sections 341, 323, 354, 504/34 of the Indian Penal Code.
The petitioners are female members of the same family. It has been submitted on behalf of the petitioners that eight members of the same family, including these petitioners, have been falsely implicated in a case arising out of some petty disputes between the parties. Though it is alleged that these petitioners banged the informant's daughter's head against a wall, there is no material to support the said allegation.
Patna High Court Cr.Misc. No.3717 of 2019(2) dt.25-01-2019 2/2 It is submitted that the manner in which the case of the prosecution has been narrated, is highly improbable. In view of the above submission, this application is allowed.
Let the petitioners, above-named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Danapur in connection with Dulhin Bazar Police Station Case No. 292 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
