JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is named in the first information report but according to prosecution case itself, some unknown criminals had committed the murder of the deceased and the informant doubted about the participation of the petitioner in the alleged crime on the ground that prior to the alleged occurrence petitioner had given threatening to kill the deceased. Moreover, having more or less similar allegation, some co-accused have already been granted

Patna High Court Cr.Misc. No.11238 of 2016 (2) dt.11-03-2016 2/2 privilege of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Samastipur in connection with Samastipur Muffasil P.S.
