Petitioner has filed this writ petition against settlement of platform in front of the shop of petitioner alleging therein that same has been illegally settled by the respondents authorities for extraneous reason.

Counter affidavit has been filed on behalf of respondent no.3. S.D.M., Purnea in which in para nos 7, 8 and 10, it has been stated that no such settlement of platform has been made by any authority in favour of any person. Considering the averments made in counter affidavit filed by the S.D.M., Purnea, that no platform has been settled to
