====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Mokama P.S. Case No. 241 of 2019 for the offenses under Sections 414/34 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that in the instant case it is alleged that from the possession of the petitioner stolen motorcycle was seized. So far as the recovery of arms is concerned, one country made khatta with three live cartridges were recovered from the possession of the co-accused but not from the present petitioner. It is further submitted that the petitioner has no criminal antecedent. The petitioner is in custody since 23.10.2019.

Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Barh, in connection with Mokama P.S. Case No. 241 of 2019.
