The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30 (a) of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is no recovery from the conscious possession of the petitioner rather 30 litres of Mahua liquor is said to have recovered from the house of the petitioner which is joint family property. He submits that no independent witnesses have put the signature on the seizure list which create doubt upon the whole prosecution case. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.
Patna High Court CR. MISC. No.4130 of 2023(2) dt.06-04-2023 2/2 Learned APP for the State opposes the prayer for bail.
Considering the fact that the illicit liquor has been recovered from the house of the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Deo P.S. Case No. 321 of 2022.
