JUSTICE AMARESH KUMAR LAL ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offence punishable under Sections 302/201/34 of the Indian Penal Code.

Allegation against the petitioner is to have killed his wife and disposed of the dead body. Prior to the occurrence there was dispute between the wife and the husband. The allegation against the petitioner is that he has married another lady. Learned counsel for the petitioner has submitted that the petitioner is the husband of the deceased and he was leading conjugal life happily and three children were born out of their wedlock. It appears that due to dysentery the deceased died. Learned counsel for the State submits that the witnesses have supported the prosecution case. No witness has stated that the petitioner has taken any step for the treatment of the deceased. After investigation the case has been found true against the petitioner and others.

Considering the facts and circumstances, in my opinion, the petitioner does not deserve bail at this stage. His prayer for bail is rejected.
