The petitioner being the husband of the victim has renewed his prayer for bail in a case registered for the offences punishable under Section 304B of the Indian Penal Code since the petitioner is languishing in custody since 22.10.2013. The accusation is of killing the daughter of the informant for non-fulfillment of the dowry demand. The report of learned Additional District & Sessions Judge-IVth, Patna dated 22.09.2016 at Flag 'X' reflects that five witnesses have already been examined. Though a petition has been filed on behalf of the petitioner before learned court below for declaring him juvenile and the matter is pending for
Patna High Court Cr.Misc. No.9350 of 2016 (3) dt.07-12-2016 2/2 evidence on the point of juvenility of the petitioner. Considering the advance stage of the trial, this Court is not inclined to consider the prayer for bail of the petitioner. Accordingly, this application is disposed. It is expected from the learned trial court to conclude the trial expeditiously.
