The petitioners seek bail in a case registered under section 302 and other allied sections of the Indian Penal Code.

Petitioners are named in the first information report along with other accused persons. The informant made allegation that accused Rakesh Sao and Bijay Sao armed with iron rod assaulted Arun on his head and he fell down on the ground. Sanjay and Munna Sao assaulted Anjaney Kumar Bharti . Rakesh Sao also assaulted the driver of the vehicle of Arun Kumar. Arun

Patna High Court Cr.Misc. No.13921 of 2015 (2) dt.23-04-2015 2/2 Kumar died during the course of treatment. The petitioners are not the assailant of the deceased. Accused Shankar Sao has already been granted anticipatory bail vide order passed in Cri. Misc. No. 3928 of 2015.

Considering the facts aforesaid the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in Kotwali P.S. Case No. 636 of 2014.
