Mr.Md. Shakir Ahmad ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Bikramganj P.S. Case No. 08 of 2018 registered for the offence under Section 394 of the Indian Penal Code.

Learned Counsel appearing on behalf of the petitioner submits that petitioner was not named in the F.I.R.. The instant case was registered against unknown and the name of the petitioner surfaced on the confessional statement of co-accused Ramesh Kumar Raj alias Ramesh Kumar and the said Ramesh Kumar Raj alias Ramesh Kumar was granted regular bail by Co-ordinate Bench of this Court in Cr. Misc. No. 33387 of 2018 vide order dated 26.09.2018. He further submits that petitioner has not been put on TIP as yet.

No.4271 of 2019(2) dt.28-01-2019 2/2 Considering the fact that the co-accused on whose confessional statement the name of the petitioner surfaced in the instant case has already been granted regular bail by co-ordinate Bench of this Court and the petitioner has not been put on TIP as yet, let the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magisgtrate, 1st, Bikramganj in connection with Bikramganj P.S. Case No. 08 of 2018.
