JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302/34 of the Indian Penal Code and 27 of the Arms Act.

Petitioner is not named in the first information report and the informant lodged the present case disclosing this fact that one, Pankaj Kumar S/o bikram Singh of his village gave information about the death of deceased of the present case and after that, the informant came to his village and learnt that two unknown persons committed murder of the deceased. In course of investigation, the informant disclosed that wife of the petitioner had contested election of Up Mukhiya and the deceased had opposed the candidature of the petitioner's

Patna High Court Cr.Misc. No.12434 of 2016 (2) dt.18-03-2016 2/2 wife and that was the reason, the petitioner having entered into conspiracy with one Guddu Singh got eliminated the deceased. It appears that not a single witness has claimed to have seen the petitioner, committing murder of the deceased and except suspicion on the ground of political rivalry, there appears to be nothing against petitioner.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Pasraha P.S. Case No. 119 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Khagaria. (Hemant Kumar Srivastava, J) A.K.V./- U T
