JUSTICE SUDHIR SINGH ORAL ORDER 08-06-2015 Since both these applications arise out of the same first information report, they have been heard together and are being disposed of by a common order.
The petitioners of these applications are languishing in custody since 21.11.2014 and 22.07.2014, respectively, in connection with Naubatpur P.S. Case No. 314 of 2014 for the offences instituted under Section 302 read with Section 34 and 379 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution story, in brief, is that the informant was at his home and in the meantime the villagers raised hulla by stating that his brother Radhanandan @ Mantu has been murdered in village Khajuri Chouraha by the accused persons and they snatched away the vehicle of the deceased.
It has been submitted on behalf of the petitioners that no specific allegation has been made against the petitioners and general and omnibus allegations have been made. It has further been submitted that the petitioners have no criminal antecedent and they are in custody since 21.11.2014 and 22.07.2014, respectively. It has been submitted on behalf of the State that the petitioners are named in the first information report. Considering the aforesaid facts and circumstances of the case, let the petitioners of both these applications, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Kumar Madhavendra, Judicial Magistrate, Ist Class, Danapur in connection with Naubatpur P.S. Case no. 314 of 2014.
