Petitioners, who are in custody, seek bail in connection with N.D.P.S. Case No. 28 of 2018, arising out of Sonepur Rail P.S. Case No. 165 of 2018 registered for the offences punishable under Sections 08, 20, 22 of N.D.P.S. Act. Allegation is recovery of 20.200 Kg. of Ganja from the joint possession of petitioners at Railway platform. It has been submitted on behalf of the petitioners they have no criminal antecedent and they have been falsely implicated in this case. However, since there is recovery of commercial quantity of Ganja from the possession of three

Patna High Court Cr.Misc. No.5951 of 2019(2) dt.13-02-2019 2/2 petitioners, I am not inclined to enlarge the petitioner on bail at this stage. Hence, the prayer for bail of the petitioners is hereby rejected.

However, after completing one year of the custody, the petitioners would be at liberty to renew their prayer for grant of bail.
