Let the defect(s), if any, as pointed out by the office be removed within a period of four weeks from today. The petitioner seeks bail in connection with Basopatti P.S. Case No. 197 of 2021 registered for the offences punishable under Sections 323, 341, 379, 354(B) 307, 504 and 34 of the Indian Penal Code.

The allegation against the petitioner is that he and other co-accused persons assaulted the informant and his family members due to some land dispute.

Learned counsel for the petitioner has submitted that petitioner has been implicated in this case due to land dispute

Patna High Court CR. MISC. No.4030 of 2022(2) dt.08-06-2022 2/3 which has been admitted in the FIR. The FIR has been registered belatedly for an occurrence of 01.08.2021, the same was registered on 06.08.2021. The petitioner is in custody since 17.09.2021.

Learned APP has opposed the submission of learned counsel for the petitioner.

Having regard to the submission made hereinabove and considering the fact that there appears to be some land dispute between the agnates and further considering the custody period, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Madhubani in connection with Basopatti P.S. Case No. 197 of 2021, subject to the following conditions:

(i) One of the bailors will be a close relative of the petitioner, preferably one of his parents.

(ii) The petitioner will remain present on each and every date fixed by the court below and not delay the trial. In case of absence for three consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
