JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 11-08-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioner as well as Mr. J.N. Thakur, the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Alauli P.S. Case No. 395 of 2020, registered for the offence under Sections 342, 354(c), 354(D), 376(D), 504, 506, and 34 of the Indian Penal Code and under Section 67 of the I.T. Act. The learned counsel for the petitioner has submitted that the allegation of rape is not against the petitioner, rather it is against co-accused Amit Kumar. The allegation against other accused persons including the petitioner is that they made the video clip of the informant viral on social media. He has submitted further that there is nothing on record which shows that the video clip was made

Patna High Court CR. MISC. No.3663 of 2022(2) dt.11-08-2022 2/2 viral by using the account of present petitioner. He has submitted further that the marriage of the victim was solemnized two years prior to the occurrence. He has also submitted that when the informant perceived that this case has been lodged mistakenly, she has filed a compromise petition.

On the other hand, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 395 of 2020, subject to condition as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
