JUSTICE GOPAL PRASAD ORAL ORDER 31-07-2015 Both the cases are being heard together and are being disposed off by this common order. Heard the learned counsel for the petitioners and the State.
This is a petition for grant of regular bail for offence under Section 392 of the Penal Code.
The learned counsel for the petitioners submits that the material against the petitioners is the confessional statement of the co-accused and their own before police and there is recovery of Rs.31,000/- and Rs.34,000/- respectively.
The learned counsel for the State submits
Patna High Court Cr.Misc. No.19862 of 2015 (3) dt.31-07-2015 2/2 that there is allegation of loot of rupees two lakhs and the investigation claimed to have identified the petitioners. However, neither the money, recovered from the house of the petitioners, was put on test identification parade nor there is any description of the notes, which were looted out nor the petitioners have been put on test identification parade.
Hence, having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Saraiya P.S. Case No. 77 of 2015 to the satisfaction of the Subdivisional Judicial Magistrate, West, Muzaffarpur.
