JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. In huge quantity, country-made liquor was recovered from a rice mill. The guard of the aforesaid rice mill, disclosed that the petitioner and one, Uma Shankar Pandey had installed machines etc. for manufacturing country-made liquor. Submission on behalf of petitioner is that co-accused, Uma Shankar Pandey has already been granted privilege of bail by a coordinate bench of this court vide order dated 12-03-2015 passed in Cr. Misc. No. 9344 of 2015 whereas; the petitioner is languishing in jail custody since 25-08-2015. The learned trial court has reported that the case is

Patna High Court Cr.Misc. No.18379 of 2016 (3) dt.07-09-2016 2/2 still pending for appearance of some co-accused persons and even charge could not be framed against the petitioner and other accused.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Nawanagar P.S. Case No. 87 of 2014 to the satisfaction of Mr. L. K. Mishra, learned Judicial Magistrate-Ist Class, Buxar.
