JUSTICE PRABHAT KUMAR JHA ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned counsel for the State. The petitioner seeks bail in Nawada Town P.S. Case No. 809 of 2014, registered for the offences punishable under Sections 498A, 406, 341, 504, 379, 307 and 34 of the Indian Penal Code.
The wife-informant made allegation of demand of dowry and torture and also alleged that the petitioner assaulted her and tried to kill her by strangulating her.
Learned counsel for the petitioner submits that the present case was lodged on 30.12.2014, prior to lodging of this case, Complaint Case No. 2134 of 2014 was lodged on 02.12.2014 with regard to the occurrence took place on 01.12.2014
Patna High Court Cr.Misc. No.14119 of 2015 (2) dt.23-04-2015 2/2 immediately thereafter, the wife has also filed maintenance case on 03.12.2014. The petitioner is in jail since 30.12.2014. Learned counsel for the informant submits that the brother of the informant transferred Rs. 3,50,000/- within five years in the name of the informant as demanded by the petitioner. Considering the facts aforesaid and the nature of allegations made against the petitioner and the fact that the petitioner has already remained in jail for about four months, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 809 of 2014.
