The petitioner seeks bail in Rajapakar P.S. Case No.199 of 2019 registered for the offence punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1b)A/26/35 of the Arms Act The allegation against the petitioner is of recovery of a sixer ( revolver) and two live cartridges of 7.65 mm. Submission of learned counsel for the petitioner is that the petitioner has been falsely implicated in the present case having no criminal antecedent and he is in custody since 21.08.2019. Further submission is that nothing has been recovered from the possession of the petitioner, rather recovery was made from other accused persons and since the petitioner denied to be a witness, he has been made accused.

In view of facts and circumstances, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-(twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate XIII, Vaishali at Hajipur in connection with Rajapakar P.S. Case No.199 of 2019.
