JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2019 This is an application for grant of anticipatory bail in connection with Bettiah (Town) P.S. Case No. 319 of 2017, disclosing offences under Sections 272, 273 of the Indian Penal Code and Sections 30, 33, 34, 36, 38(i) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioners and other accused persons is of manufacturing the illicit liquor and some accused persons were arrested and seizure list was prepared. Submission of learned counsel for the petitioners is that nothing has been recovered from their conscious possession. Further, they have no criminal antecedents. Heard learned A.P.P. also.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, West Champaran at Bettiah, in connection with Bettiah (Town) P.S. Case No. 319 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
