JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-47(a), 47(f) of the Bihar Excise Act. 105 litres country-made liquor and 800 kg unripe country-made liquor are said to have been recovered from the bank of a river. Petitioner was neither caught at the spot nor anything was recovered from his conscious possession. No doubt, petitioner does have some criminal antecedent but in the present case, except the aforesaid material, there is nothing against him.
Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten
