2. The petitioner has invoked the jurisdiction of this Court seeking a direction upon the respondent to ensure payment of his pension after calculating the increment in accordance with Pay scale/grade pay which was provided at the time of his retirement.
3. A counter affidavit has been filed on behalf of respondent Nos. 2 and 3. A categorical averment has been made that in view of the departmental direction the corrected pension forms have been sent to the office of the Accountant General, Bihar by the District Welfare Officer, Banka after verification of
Patna High Court CWJC No.1241 of 2022(6) dt.06-08-2024 2/2 service book for sanction of pension in favor of the petitioner and the same is under process.
4. The aforenoted counter affidavit was filed way back on 18.11.2022, however, there is no response to it. For the last three consecutive dates there is no representation on behalf of the petitioner.
5. Considering the aforesaid fact the writ petition stands dismissed for non-prosecution.
