2. The petitioner seeks bail in connection with Chakiya P.S. Case No. 56 of 2024 registered for the offence under Sections 127(1), 115(2), 109 of BNS and Section 27 of Arms Act.

3. The petitioner is named in the F.I.R. and is in custody since 18.09.2024.

4. The allegation against the petitioner is to open fire upon informant causing bullet injury on his stomach who upon hospitalization succumbed to said injury.

5. Learned counsel appearing on behalf of the petitioner submitted that petitioner is a man of clean

It is submitted that admittedly as per FIR, some scuffing took place during the occurrence, where without having any intention alleged fire was made accidentally by petition causing injury on stomach of the informant. While concluding the argument, it is submitted that investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

6. Learned APP duly assisted by learned counsel for the informant while opposing the prayer of bail submitted that present FIR, is, on par of dying declaration, as same is version of injured/ deceased.

7. A report regarding, stage of trial was called for, which made available to this Court through letter no. 102 dated 18.07.2025. It appears from aforesaid report that charge has already been framed on 19.02.2025, thereafter steps were taken for examination of prosecution witnesses and as such the next date for recording evidence is 22.07.2025, there are only 7 charge-sheet witnesses to examined in this matter during the trial.

In view of aforesaid factual submission and by taking note of fact as allegation of open fatal fire arm injury upon stomach of informant/ injured specifically caused by this petitioner, which appears fully corroborating with postmortem report, accordingly, the prayer of bail of abovenamed petitioner stands rejected herewith for the present.

9. However, taking note of custody period as petitioner remains in custody since 18.09.2024, learned trial court is directed to conclude the trial preferably within 9 months from the date of receiving of this order, failing which, petitioner may renew the prayer of bail, if so advised.
