Let the defect(s), if any, as pointed out by the office be removed within a period of four weeks from today. The petitioner seeks bail in connection with Choutham P.S. Case No. 196 of 2021 registered for the offences punishable under Sections 395 and 412 of the Indian Penal Code.

The prosecution case is that some miscreants committed Dacoiti in the house of the informant and during investigation the name of the petitioner came up as one of the accused persons and some stolen property was allegedly

Learned counsel for the petitioner has submitted that the petitioner is not named in the FIR and has been named only on the basis of confessional statement of co-accused Sanjay Singh. No Test Identification Parade has been conducted and nothing has been recovered from this petitioner in the instant case. Petitioner is in custody since 25.09.2021 and he has been made accused in Uda Kishunganj P.S. Case No. 273/2021 under Section 395 of the Indian Penal Code after the instant case. Having regard to the aforesaid facts and submission made on behalf of the petitioner especially considering the period of custody, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria in connection with Choutham P.S. Case No. 196 of 2021, subject to the following conditions:

(i) One of the bailors will be a close relative of the petitioner, preferably one of his parents.

(ii) The petitioner will remain present on each and every date fixed by the court below and not delay the trial. (iii) In case of absence for three consecutive dates or
