The petitioner seeks regular bail in connection with Vishambharpur P.S.Case No.128 of 2019 (G.R. No.1241 of 2019) registered for offences punishable under Sections 30(a) / 37(c) of the Bihar Prohibition and Excise Act, 2016 . Allegation against the petitioner is about recovery of 20.200 ltrs. of liquor from the motorcycle of the petitioner and the petitioner succeeded in fleeing away from there. Submission of the learned counsel for the petitioner is that he was not arrested at the spot and the motorcycle does not belong to him as well as having no criminal antecedent and he is in custody since 24.10.2019 . Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge-II cum Special Judge (Excise), Gopalganj in connection with Vishambharpur P.S.Case No.128 of 2019 (GR.No.1241 of 2019).

With the aforesaid observation, this application is allowed.
