JUSTICE SHIVAJI PANDEY ORAL ORDER 16-06-2015 Heard learned counsel for the petitioner and learned counsel for the State as well as the informant. The petitioner seeks bail in a case instituted for the offences under Sections 406 and 420 of the Indian Penal Code and Section 138 of the negotiable Instrument Act. In the present case the dispute is with regard to paymentof Rs.14,00,000, out of which Rs.4,50,000 has been paid and the same has been accepted by learned counsel for the informant.

Learned counsel for the petitioner submits that admitted amount of Rs.7,50,000/- will be returned to the informant within six months in equal installments and in failure to pay any installment the petitioner will be taken into custody. Rest amount of Rs.2,00,000 will be deposited by the

No.18997 of 2015 (2) dt.16-06-2015 petitioner within six months after clearance of Rs.7,50,000 in the court and that amount will be invested by the court in any nationalized Bank so that money deposited accrues interest. Any payment made will be subject to the final result of the trial. If the trial court would find that petitioner is entitled to return certain amount that amount will be returned to him. Having considered the facts and circumstances of the case and the submission made by learned counsel for the petitioner, let petitioner, Ramu Murmu, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in K. hat P.S. Case No.412 of 2014, subject to the conditions that one of the bailors shall be a close relative of the petitioner.
