JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 120B of the Indian Penal Code and Sections 25(1-b)a, 26 of the Arms Act. One country made loaded katta and eight live cartridges were recovered from conscious possession of the petitioner when allegedly, petitioner along with others assembled to make preparation for committing dacoity for which petitioner is in jail custody since 11.01.2016. It appears that prior to institution of the present case, only one case i.e. Dhansoi P.S. Case No. 33 of 1997 had been registered against the petitioner. Considering the aforesaid facts and circumstances as

No.11128 of 2016 (2) dt.10-03-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VII, Buxar in connection with Rajpur P.S. Case No. 11 of 2016.
