2. Heard learned counsel for the petitioners and learned APP for the State.
3. Petitioners apprehend their arrest in connection
Patna High Court CR. MISC. No.75360 of 2022(5) dt.17-07-2023 2/3 with Fatehpur P.S. Case No.196 of 2022, registered for the offence punishable under Sections 409, 419, 420 and 34 of the Indian Penal Code.
4. It is alleged that petitioner, Ravikant Rai was stood terminated on 30.08.2014 for his misconduct but petitioner, Ranju Rani (the Mukhiya) was taking efforts to take said Ravikant Rai back in service by committing misconduct.
5. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Petitioner, Ranju Singh has got no criminal antecedent and petitioner, Ravikant Rai has got one criminal antecedent as stated in paragraph-3 of the bail petitions. It is further submitted that the petitioners have not committed any misconduct as per allegation made in the FIR. It is also submitted that the Mukhiya and Panchat Secretary had reinstated the service of petitioner, Ravikant Rai as per the direction issued by the District Programme Officer vide Letter No.842 dated 25.02.2016, therefore, allegation of misconduct is wrong, false and concocted. It is submitted that petitioner, Ravikant Rai had been appointed as Panchayat Teacher on 01.07.2006, he had worked as Panchayat Teacher till 10.09.2012 without any complaint from any corner.

6. Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioners.
7. Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Xth, Gaya in connection with Fatehpur P.S. Case No.196 of 2022, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J) S.KUMAR/- U T
