JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 The petitioner seeks regular bail in connection with Baikunthpur P.S. Case No. 138 of 2016, registered for offences punishable under Sections 147, 148, 149, 447, 341, 323, 354, 427, 436, 504, 379 of the Indian Penal Code.
Allegation as per F.I.R. is that petitioner and other accused persons came to the informant and assaulted him and his family members and it is alleged that petitioner set the house on fire causing loss of articles worth Rs. Lakh. It has been submitted on behalf of the petitioner that there was land dispute between the parties and the land in question was decreed in favour of the petitioner and the real fact is that it is the informant and others, who themselves have set the house on fire. Further submission is that he has no criminal antecedent and has been in judicial custody since

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -V, Gopalganj, in connection with Baikunthpur P.S. Case No. 138 of 2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
