It is submitted on behalf of the petitioner that, despite the application filed under Clause 16 of the terms and conditions of the agreement between the petitioner and the respondent-BSFC, as per the direction of this Court, no progress is there in the conciliation matter as even no date has been fixed till date whereas certificate cases have been filed and first information report has also been lodged against him which is against the spirit of the order passed by this Court on 22.7.2014

Patna High Court CWJC No.6276 of 2015 (3) dt.22-05-2015 2/2 in C.W.J.C. No. 9133 of 2013 and in C.W.J.C. No. 10725 of 2014 dated 19.11.2014.

Accordingly, this writ application is being disposed of with a direction to the Managing Director, BSFC to proceed in the matter under Clause 16 of the terms and conditions of the agreement and take steps for disposal of the same within four weeks from today .

In the meantime, let no coercive action be taken against the petitioner for recovery in the certificate case concerned till such decision is taken by the respondent concerned, if the same has not already been taken.
