The petitioner is accused in connection with Kharagpur P.S. Case No. 97 of 2012 registered under Sections 395 and 397 of the Indian Penal Code but later on the charge sheet has been submitted under Sections 392 and 412 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation on the basis of confessional statement of co-accused, Bimal Kumar Singh, petitioner has falsely been implicated in this case. Patna High Court Cr.Misc. No.19353 of 2015 (3) dt.09-09-2015 already been granted privilege of bail by this Court vide order dated 01.02.2013 passed in Criminal Misc. No. 2360 of 2013. It is further submitted that petitioner being no criminal antecedent is in custody since 19.02.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger, in connection with Kharagpur P.S.
