The petitioner seeks bail in a case registered under Sections 328, 379 and 307 of the Indian Penal Code. The informant alleged that one unknown person offered a biscuit stressing him to eat and after consuming the same, he became unconscious. He found himself in a Hospital. His belongings, such as, mobile, cash, etc. were taken away. The petitioner is not named in the first information report. The stolen mobile (cell) has been recovered from the possession of the petitioner.

It is submitted that the petitioner is a labour. The son of his owner handed over the mobile (cell) to the petitioner. Except this, there is no evidence to show the involvement of the petitioner

Patna High Court Cr.Misc. No.20867 of 2015 (2) dt.18-06-2015 in this case. The petitioner is in jail since 6.12.2014. The petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Rail Magistrate, Patna in connection with G.R.P.
