The petitioner apprehends his arrest in connection with Bihiya P.S. Case No.339 of 2021 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a)(c) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner rather recovery has been made from the bank of river near Bulaki Tola. The petitioner has got no criminal antecedent. Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the

Case No.339 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
