====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-02-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. This is second modification petition filed for extension of time. Earlier, vide order dated 21/12/21 passed in Cr. Misc. No:-47827/2021 petitioner had been granted pre-arrest bail with direction to surrender and furnish bail bonds within 30 days of the order but petitioner could not surrender within the stipulated time because of Pandemic of Corona Virus. Thereafter, petitioner filed Cr Misc No. 41411/2024 for extension of time to surrender and the same was allowed vide order dated 06.09.2024 with the cost of 15,000/- and petitioner was granted 4 weeks time to surrender but again petitioner could not surrender within said time period on the ground of illness.
3. In view of reason assigned in the modification petition, further six weeks time from today is granted to the petitioner to surrender and furnish bail-bond before the concerned Court where the case is pending.
4. Since, petitioner has come to the Court for
Patna High Court CR. MISC. No.3138 of 2025(2) dt.28-02-2025 2/2 modification of order passed in 2021, let the petitioner deposit Rs. 20,000/- (Rupees twenty thousand) in the office of concerned District Legal Services Authority and to furnish its receipt with the bail-bond.
5. Accordingly, said order is modified to the extent indicated above.
