The petitioner is languishing in custody since 30.09.2015 in a case registered for the offences punishable under sections 20/22/23 of the NDPS Act.

The house of co-accused Md. Munna @ Rummy was raided when some of the miscreants tried to escape from his house but nine persons were apprehended including the petitioner and beneath the bed of the house 30.07 gm of smack and 182 gm of ganja were recovered.

It is submitted by learned counsel for the petitioner that no recovery was made from the possession of the petitioner. In fact, recovery has been made beneath the bed from the house of co-accused Md. Munna@Rummi Hasan @ Runi Hasan. The

Patna High Court Cr.Misc. No.12462 of 2016 (2) dt.18-03-2016 2/2 investigation has already concluded. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Moreover, co-accused Md. Munna @ Rummi Hasan @ Runi Hasan has been granted bail vide Criminal Miscellaneous No.1147/2016.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge, Muzaffarpur in connection with Ahiyapur P.S.
