The petitioner seeks regular bail in connection with Laxmipur P.S. Case No. 164 of 2019 for the offence punishable under Sections 25(1-b)a, 26 of the Arms Act.

The allegation is regarding recovery of one rifle from the hut of the petitioner.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and is languishing in custody since 16.10.2019.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to direct for release of the petitioner immediately upon completion of six

Patna High Court CR. MISC. No.4712 of 2020(2) dt.23-01-2020 2/2 months of his custody i.e. w.e.f. 16.10.2019 and further subject to such condition as may be imposed by the learned court of C.J.M., Jamui in connection with Laxmipur P.S. Case No. 164 of 2019.

The petition stands disposed of with the aforesaid observations and directions.
